These Terms & Conditions ("Terms") govern your use of services provided by Maaco PDX ("Maaco PDX", "we", "us", or "our"), including our website, communications, and SMS messaging program. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our website, scheduling services, requesting estimates, or subscribing to our SMS messaging program, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional terms and policies referenced herein such as our Privacy Policy. If you do not agree with these Terms, you must not use our services.

2. SMS Messaging Program

Maaco PDX may offer an SMS messaging program (the "SMS Program") that allows you to receive text messages related to appointment reminders, repair updates, promotional offers, service follow-ups, and other transactional or marketing communications. Participation in the SMS Program is voluntary and subject to these Terms and all applicable laws and regulations.

By enrolling in the SMS Program, you consent to receive automated text messages (which may be sent using an autodialer) to the mobile number you provide. Consent to receive marketing messages is not a condition of purchasing any goods or services from Maaco PDX.

3. How to Opt In

You may opt in to the SMS Program in one or more of the following ways:

Providing your mobile number and affirmatively consenting to receive text messages when requesting an estimate, booking an appointment, or completing a form on our website.
Opting in verbally or in writing at our Maaco PDX location when asked whether you wish to receive text updates or promotions.
Responding to an invitation text message with a keyword or code that clearly indicates your consent, if applicable.

By opting in, you represent that you are the owner or authorized user of the mobile number provided and that you are at least 18 years of age or have the consent of a parent or legal guardian.

4. How to Opt Out

You may opt out of receiving SMS messages from Maaco PDX at any time. To stop receiving messages:

Reply STOP to any SMS message you receive from us; or
Contact us directly using the contact information in the Contact Us section below and request that your number be removed from the SMS Program.

After you opt out, you may receive a final confirmation message to verify that your opt-out request has been processed. Following confirmation, you will no longer receive marketing SMS messages from Maaco PDX at that number, but we may still contact you by phone or email as permitted by law and our Privacy Policy.

5. HELP Command

If you need assistance with the SMS Program, you can reply HELP to any SMS message you receive from us. In response, you will receive a message with information about how to contact us for additional support and how to opt out. You may also contact us directly using the contact information provided in the Contact Us section of these Terms.

6. Message Frequency & Rates

Message frequency will vary based on your interactions with Maaco PDX, such as scheduling services, requesting updates, or responding to promotions. You may receive both transactional and marketing messages, but we strive to keep our messaging relevant and reasonable in volume.

Message and data rates may apply to each SMS message sent or received in connection with the SMS Program, as determined by your mobile carrier. Maaco PDX is not responsible for any charges imposed by your carrier for SMS messages or data usage. Check with your mobile carrier for details about your pricing plan and applicable fees.

7. Limitation of Liability

To the fullest extent permitted by law, Maaco PDX will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, arising out of or related to your participation in the SMS Program or your use of our services, even if we have been advised of the possibility of such damages.

Without limiting the foregoing, Maaco PDX is not responsible for any delays, failures, or misdelivery of SMS messages, or for any errors in the content of messages, due to circumstances beyond our control, including but not limited to network issues, carrier performance, or device compatibility. Your sole and exclusive remedy for any claim arising out of or relating to the SMS Program is to discontinue participation in the program.

8. Governing Law

These Terms, including those relating to the SMS Program, are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles. Any disputes arising from or relating to these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Oregon, and you hereby consent to the personal jurisdiction of such courts.

9. Changes to Terms

We may update or modify these Terms from time to time to reflect changes in our practices, services, or applicable laws. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our services or participation in the SMS Program after any changes become effective constitutes your acceptance of the revised Terms.
